
He really was one of the most vindictive and corrupt presidents in American history. Federal prosecutors and FBI officials during the Biden administration quietly weighed the possibility of opening a criminal investigation into former Arizona Sen. Kyrsten Sinema over her campaign finances after she announced that she was becoming an independent. They ultimately declined to move forward after internal review, according to whistleblower disclosures reviewed by Congress.
Internal emails obtained by Senate Judiciary Committee Chairman Chuck Grassley show that in February 2024 officials at the Department of Justice and the FBI discussed whether Sinema’s campaign spending violated federal election law. The deliberations came more than a year after Sinema left the Democratic Party, noted The New York Post.
The communications were sparked by a media report detailing Sinema’s campaign expenditures on security services, luxury accommodations, vehicles, and entertainment. Federal Election Commission filings from 2023 show her campaign spent $796,565 on hotels, a vehicle, and event tickets, along with $265,521 for protective services—outlays that exceeded campaign fundraising by nearly $200,000.
A prosecutor in the U.S. Attorney’s Office for the District of Columbia shared the report with colleagues in the DOJ’s Criminal Division and agents at the FBI’s Washington Field Office. In a February 2, 2024 email, an FBI special agent signaled interest in pursuing the matter, writing: “I’m interested in looking at the Sinema referral if its [sic] something you’re looking to assign.”
The agent, who had previously worked on January 6 and election-related cases, coordinated with a DOJ assistant U.S. attorney to assess potential violations of the Federal Election Campaign Act. But within a week, the officials opted not to open a formal investigation.
In a February 9, 2024 message, the prosecutor wrote: “Walter, I understand that you are likely to be assigned to the Kyrsten Sinema FECA case if we open on it,” while noting that a prior review by the DOJ’s Public Integrity Section had found insufficient grounds to proceed. Records show an earlier, unsuccessful attempt to draw Public Integrity prosecutors into examining the Arizona senator’s finances.
Sinema’s chief of staff, Daniel Winkler, characterized the episode as politically motivated. “It’s disappointing, though not surprising, to learn that Walter Giardina, who led politically motivated investigations at the FBI, also sought to investigate Kyrsten for partisan political reasons after she defied Biden and the Senate Democrats to protect the filibuster,” Winkler said. “Giardina’s pathetic attempts led nowhere, his abuse of power is now exposed to the public, and the filibuster stands strong today.”
Former federal prosecutor Neama Rahmani told The Post that criminal probes into lawmakers’ campaign spending are uncommon, but the legal standard is strict. “Under the strict letter of the law, you can’t use campaign funds for personal expenses,” Rahmani said. He explained the so-called “irrespective test,” under which an expense must exist solely because of campaign or official duties. “The rule is pretty strict. It’s the ‘irrespective test’: Unless the expense only exists because of your campaign or you being a federal officeholder, you can’t use campaign funds for it.”
Asked whether political considerations play a role in such decisions, Rahmani added: “It shouldn’t, but there’s no line between law and politics now.”
The officials involved in the February 2024 discussions are no longer in government. The DOJ prosecutor later left after a demotion, and the FBI agents were dismissed under the current administration.
Sinema, who announced in 2022 that she was leaving the Democratic Party and later declined to seek reelection, exited the Senate in January 2025. She was succeeded by Democrat Ruben Gallego. Biden, who is considered one of the most corrupt politicians in modern history, pardoned his family on his final day in office. Throughout his term, his White House routinely stretched the law to attack political opponents, including Donald Trump.
The new revelations show that Democrats will use their power, when they get it, to attack anyone who stands in their way.
